Terms and Conditions | TourHelp

1. About these terms

These terms and conditions govern your use of the TourHelp website at www.tourhelp.co.uk (the “Website”). Please read them carefully.

In these terms, “TourHelp”, “we”, “us” and “our” mean the legal entity that operates the Website. “You” and “your” mean anyone accessing or using the Website.

Company Information

  • Legal entity: TOUR HELP GROUP LTD
  • Company number: 14981966
  • Registered office: 12 South Close, Crawley, West Sussex, United Kingdom, RH10 8DG
  • Email: info@tourhelp.co.uk

By using the Website, you agree to these terms. If you do not agree, please do not use the Website. These terms apply to Website use; they do not replace any separate terms that apply to a holiday, flight, accommodation, transport or other travel booking.

2. Our role and travel bookings

The Website may provide information about travel services, allow you to submit enquiries, or direct you to suppliers or other booking providers. The role TourHelp performs for a particular booking will depend on the information given to you during the booking process and the booking confirmation.

A booking may be made with TourHelp as an agent, with TourHelp acting as a principal, or directly with a third-party supplier. Before you pay or confirm a booking, check the booking documents to identify the contracting party, the services included, the total price, payment schedule, cancellation and amendment terms, and any applicable travel-protection arrangements.

Website enquiries, displayed prices and availability are not, by themselves, confirmation that a booking has been accepted. A booking is confirmed only in accordance with the applicable booking process and confirmation documents.

These Website terms do not change or remove any rights you have under applicable consumer law. If there is a conflict between these terms and the specific terms properly applicable to a confirmed booking, the booking terms will govern that booking to the extent of the conflict, subject to applicable law.

3. Website information and availability

We aim to keep the Website information accurate and up to date, but travel prices, schedules, availability, supplier information and other details can change. Information may be supplied by third parties. We do not guarantee that all Website content is complete, current or error-free.

We may correct errors, update content, change or withdraw Website features, or suspend access for maintenance, security or operational reasons. Where a booking has already been confirmed, your rights will be governed by the applicable booking terms and law.

You should verify important travel information with the relevant supplier and review your booking confirmation and travel documents before travelling. Nothing in this section excludes liability where doing so would be unlawful.

4. Acceptable use

You may use the Website only for lawful purposes. You must not:

  • use the Website in breach of any applicable law or regulation;
  • attempt to gain unauthorised access to the Website, its servers, accounts or connected systems;
  • introduce viruses, malicious code or other harmful material, or interfere with the Website’s security or operation;
  • use automated systems to scrape, copy or collect Website content or data in a way that is unauthorised or disrupts the Website;
  • copy, reproduce, republish, distribute, commercially exploit or create derivative works from Website content except as permitted by law or with our written permission;
  • submit information that is knowingly false, misleading, unlawful or infringes another person’s rights; or
  • use the Website to send unsolicited advertising, spam or other unauthorised promotional material.

We may take reasonable steps to protect the Website and our users if we reasonably believe these terms have been breached. Any action we take will be subject to applicable law.

5. Intellectual property

Unless stated otherwise, the intellectual property rights in the Website and its original content—including text, graphics, logos, design and software—belong to TourHelp or our licensors.

You may view and print reasonable extracts for your personal, non-commercial use. You must not reproduce, modify, distribute, commercially exploit or republish Website content without our prior written permission, except where permitted by law.

Third-party names, logos, trade marks and content remain the property of their respective owners. Nothing on the Website grants you a licence to use them.

6. User submissions, reviews and comments

If the Website allows you to submit reviews, comments, photographs or other material (“User Content”), you are responsible for ensuring that your submission is accurate where it purports to state facts, lawful, and does not infringe another person’s rights.

By submitting User Content, you confirm that you have the rights and permissions needed to submit it and to grant the licence below. You must not submit content that is defamatory, threatening, discriminatory, obscene, deceptive, unlawful, invades privacy, infringes intellectual property rights, or promotes unlawful activity or unsolicited commercial activity.

You grant TourHelp a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and publish your User Content for the purpose of operating, promoting and improving our services and Website. This licence lasts for as long as reasonably necessary for those purposes, subject to applicable law and any rights you may have to withdraw consent where consent is the legal basis for processing. If we intend to use a review, image or other submission in a materially different way, we will obtain any additional permission required by law.

You retain ownership of your User Content. You should not submit personal information about another person unless you have a lawful basis and any required permission.

We do not promise to pre-screen all User Content. We may review, restrict or remove content where reasonably necessary, including where it appears to breach these terms or the law. If you believe content on the Website is unlawful or infringes your rights, contact us using the details in section 14 and provide enough information for us to identify it.

7. Links to third-party websites

The Website may contain links to websites, booking platforms, payment providers, travel suppliers or other third parties. These links are provided for convenience and do not necessarily imply that TourHelp endorses the linked service.

Third-party websites and services are controlled by their respective providers and may have their own terms, privacy notices and policies. We are not responsible for their content or practices, except to the extent liability cannot lawfully be excluded. Review the relevant third-party terms before using their services or providing payment or personal information.

8. Linking to our Website and framing

You may link to our publicly available pages provided that the link is lawful, fair and not misleading, does not falsely suggest that we sponsor or endorse you, and does not damage our reputation.

You must not use our name, logo or other branding in a way that suggests an association or endorsement without our prior written permission. You must not frame or embed the Website in a way that materially misrepresents its content, branding or ownership, or otherwise infringes our rights.

We may ask you to remove a link that we reasonably consider to be misleading, unlawful or harmful. You must comply with a reasonable request to remove it.

9. Cookies and similar technologies

We use cookies and similar technologies as described in our Cookie Policy. Strictly necessary technologies may be used where permitted by law. We will request consent before using non-essential cookies or similar technologies where consent is required.

You can manage your preferences through our cookie controls, where available. Simply continuing to use the Website does not, by itself, constitute consent to non-essential cookies.

Please read our Cookie Policy for details of the technologies used, their purposes and how to manage your choices. The Cookie Policy should reflect the Website’s actual configuration and must be kept up to date.

10. Privacy and personal information

Our Privacy Notice explains how we collect, use, disclose and protect personal information, and describes the rights that may be available to you under applicable data-protection law.

Please read the Privacy Notice before submitting personal information through the Website. If you provide information about another traveller, you should ensure that you are authorised to provide it and that the person has been given any information required by law.

11. Disclaimers and liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so. In particular, nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

The Website is provided for general information and is made available on an “as available” basis. To the extent permitted by law, we do not guarantee uninterrupted access or that the Website will always be free from errors, defects or harmful components. We will take reasonable care in operating the Website, but we cannot guarantee that it will be available at all times.

To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when you used the Website, or for losses caused by circumstances outside our reasonable control. This does not affect liability arising from a confirmed booking, any duty to exercise reasonable care and skill, or any consumer rights that cannot lawfully be excluded.

Where you use the Website as a consumer, nothing in these terms affects your statutory rights, including rights under the Consumer Rights Act 2015 where applicable. Any limitation or exclusion of liability will apply only to the extent that it is lawful and fair in the circumstances.

If you use the Website for business purposes, any liability limits that apply will be subject to applicable law and will not apply where prohibited by law.

12. Indemnity

If you use the Website in breach of these terms and that breach causes a third party to bring a claim against us, you may be responsible for losses that are directly caused by your breach, to the extent permitted by law. This section does not require you to indemnify us for our own negligence, breach of duty or other liability where such an obligation would be unlawful or unfair.

13. Changes to these terms

We may update these terms from time to time. The “Last updated” date at the top indicates when they were most recently revised. Changes will apply from the date they are published on the Website, unless we state otherwise.

Changes to these Website terms do not retrospectively alter a confirmed booking contract. Any changes to booking terms will be handled in accordance with the terms applicable to that booking and the law.

14. Contact us

If you have a question, complaint or concern about these terms or Website content, contact us:

Please include enough detail for us to understand and respond to your enquiry.

15. Governing law and jurisdiction

These terms and any non-contractual obligations arising out of or in connection with them are governed by the law of England and Wales, except where mandatory consumer-protection rules require otherwise.

The courts of England and Wales will have jurisdiction over disputes relating to these terms, subject to any mandatory rights you may have as a consumer to bring proceedings in another competent court.
